The Association of Faculties of Medicine of Canada (“AFMC”) has created a free, online curriculum consisting of bilingual online courses that address opioid-related topics such as public health, the review of pain, pathophysiology of pain and pharmacology of opioids, safe opioid prescribing, opioid use disorder, and legal and cultural considerations, to educate future physicians on the diagnosis, treatment, and management of pain (the “Opioid Curriculum”).
Please read these terms and conditions carefully before using this website.
Access to and use of the Opioid Curriculum are subject to the following terms, conditions and disclaimers:
AFMC hereby grants you a worldwide, non-transferrable, non-exclusive, and royalty-free license (the “License”) to use and copy the Opioid Curriculum solely for educational purposes and no other purpose. You may not use the License for any commercial purpose or gain, or otherwise profit (whether financially or otherwise) from the License. All rights not specifically granted herein are reserved by AFMC.
You may make such number of copies of the Opioid Curriculum as may reasonably be required to use the Opioid Curriculum. You may not remove any copyright, trademark, notice that refers to this disclaimer of warranties, or other similar notices appearing on documents pertaining to the Opioid Curriculum. You agree to retain identification of AFMC as the creator of the Opioid Curriculum along with any others, including subject matter experts who contributed to the Opioid Curriculum, who are designated to receive attribution, in any manner reasonably requested by AFMC.
You may not:
- Sub-license or permit third parties to use all or any part of the Opioid Curriculum or otherwise transfer to any third party any rights granted to it under this Agreement without the prior written consent of AFMC; or
- Translate, alter, arrange, transform, or otherwise modify the Opioid Curriculum in any way.
Adapted Material and Waiver of Authorship Rights
Notwithstanding the foregoing, and in addition to any rights or remedies available to AFMC in connection with your breach of the term and conditions set forth in this License and Disclaimer, to the extent that you translate, alter, arrange, transform or otherwise modify the Opioid Curriculum in breach of this License and Disclaimer, you hereby absolutely and irrevocably waive in favour of AFMC any and all authorship and moral rights (including, without limitation, rights of attribution and association and rights of integrity) in and to any Adapted Material developed by you.
No Medical Advice
AFMC does not make any warranties in respect of the medical information provided including, without limitation, with respect to its accuracy or completeness. The Opioid Curriculum is not a substitute for professional medical advice, diagnosis or treatment.
AFMC owns all right, title and interest in and to the Opioid Curriculum and any and all modifications, variances and updates thereto whether made by AFMC or third parties on its behalf.
Disclaimer of Warranties
The Opioid Curriculum is provided on an as-is and as-available basis, and AFMC expressly disclaims any and all warranties of any kind, whether express or implied, and whether or not known or discoverable. Without limiting the foregoing, AFMC makes no representations or warranties of the following: warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of latent or other defects, accuracy, or the presence or absence of errors, and any other warranty that might arise under any law.
To the fullest extent permitted by law, under no circumstances will AFMC be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages including, without limitation, damages for loss of profits, lost data, loss of use, personal injury, wrongful death or any other intangible losses, whether the action is in contract, tort, negligence or any other cause of action, arising out of your use of the Opioid Curriculum and the corresponding website.
You agree to indemnify and hold harmless AFMC and its employees and/or contractors against any claims or expenses, including legal fees, arising from any violation by you of the terms and conditions of this Notice of License and Disclaimer.
The Opioid Curriculum is available in both the English and French languages. In the event of any inconsistency or discrepancy between the English version and the French version, the English holds the original and intended content.
Acknowledgement of Support
AFMC acknowledges the funding support by Health Canada of AFMC’s “Academic Medicine Responds to the Opioid Crisis: Developing a Canada-wide, competency-based curricula for future physicians in pain management, substance abuse and addictions” initiative, pursuant to the Substance Use and Addictions Program established by Health Canada.
The views expressed herein the disclaimer, the website and the curriculum do not necessarily represent the views of Health Canada.
